Court decision

Temporary protection cannot automatically put an asylum claim on hold

An EU court ruling rejects automatic pauses of asylum claims solely because applicants have temporary protection.

Temporary protection cannot automatically put an asylum claim on hold

On 1 October 2026, the EU Court of Justice ruled that authorities cannot automatically suspend examination of an asylum application until the applicant’s temporary protection ends. The judgment in C-249/25 (Jilin) concerned a Dutch case and interprets EU rules relevant across Member States, including Spain.

People with temporary protection can also seek international protection. The two procedures can run independently, and an unsuccessful asylum application does not by itself end temporary protection. The Court confirmed that the applicable decision-making deadlines still matter, while allowing justified extensions and exceptional measures to handle genuine administrative impossibility.

This is a ruling about asylum procedure for temporary-protection beneficiaries. It does not guarantee a positive asylum decision or change Spain’s Digital Nomad or Non-Lucrative Visa requirements.

Why it matters

Temporary-protection beneficiaries retain access to an independently examined asylum claim, subject to applicable deadlines and justified exceptions.
