How to transition from A1 Employee status to Self-Employment under Spain’s Digital Nomad Visa (DNV)

Unlike a standard renewal, which can generally be submitted up to 60 days before or 90 days after the TIE expires, the same grace period does not apply to a transition from A1-covered employment to self-employment.

To avoid potential interruptions to your residence status and protect the continuity of your residence period for long-term residency purposes, it is essential to pay close attention to the applicable filing deadlines. The application should be submitted while your TIE and A1 certificate remain valid, observing the relevant 30-day period before or after the end of your previous employment.

-Applying before the new contract begins: You may submit a formal undertaking (declaración responsable) committing to complete your registration as self-employed (autónomo) on the contract's start date.

-Applying after the new contract begins: You have up to 30 days from the contract's start date to notify the Unidad de Grandes Empresas (UGE). As the contract is already in effect, you must provide evidence that you have registered with both the Agencia Tributaria (Spanish Tax Agency) and the Régimen Especial de Trabajadores Autónomos (RETA). A declaration of future commitment is not sufficient in this situation.

⚠️UGE Applies Stricter Requirements to Autónomo Registration

The Unidad de Grandes Empresas (UGE) takes a strict approach to the registration obligations of Digital Nomad Visa (DNV) holders who transition to, or operate under, self-employed status in Spain.

Immediate registration is required. Once the relevant authorisation becomes effective or the designated contract start date arrives, applicants MUST complete their registration as self-employed (autónomo) with both the Agencia Tributaria (Spanish Tax Agency) and the Régimen Especial de Trabajadores Autónomos (RETA), as applicable. Applicants should not assume that an additional grace period will be available.

Also, the UGE ACTIVELY verifies applicant's registration status against the relevant tax and Social Security records. Where the authorisation is based on self-employment, the effective registration dates should be consistent with the applicable authorisation and commencement of activity.

If you apply using a commitment pledge, completing your Autónomo setup on Day 1 of your contract is mandatory. The UGE will almost always look up your Social Security status before giving you the green light.

Unless you terminate your employment early, the ideal start date for your self-employment contract is the day immediately following the end of your A1 coverage.

Tax considerations: If you are currently benefiting from Spain's special expat tax regime (commonly known as the Beckham Law), seek advice from a qualified tax adviser before making the switch. The change in professional status may affect your tax position, and the timing should be assessed in light of your individual circumstances and the applicable tax rules.

Document Requirement Details and Notes
New Service Contract(s) Service agreement(s) explicitly authorising the applicant to provide services remotely as an independent contractor. To obtain a residence permit valid for up to three years, these contracts should be indefinite, subject to the applicable requirements.
Spanish Autónomo Registration: Commitment or Proof Depending on the application stage, submit either a signed declaration (declaración responsable) undertaking to register as autónomo on the first day of the new contract, or official proof of active registration with the Agencia Tributaria (Form 036/037, as applicable) and the Régimen Especial de Trabajadores Autónomos (RETA). Registration should be effective from the first day of the new contract.
Client Authorisation Letter A formal letter from the main client(s) expressly confirming that the applicant is authorised to provide professional services remotely from Spain as a self-employed contractor.
Proof of Client Company's Existence A Certificate of Good Standing or commercial registry extract confirming that the main client company has been operating for at least one year.
Academic Qualifications or Professional Experience Evidence of a higher education degree or at least three years of verifiable professional experience in the relevant field. Experience gained while working in Spain under a previous DNV employment authorisation may count towards the three-year requirement, subject to the applicable criteria.
Criminal Record Certificate EXEMPT: According to the requirements described for this procedure, applicants who have legally resided in Spain with a TIE for more than six months do not need to submit a new criminal record certificate from their country of origin. Confirm that this exemption applies to your specific application.
Civil Status Certificates (Birth/Marriage) GENERALLY NOT REQUIRED AGAIN IN PRACTICE: Although civil status certificates may be formally exempted only in standard renewal procedures, the UGE may not request them again when the relevant family relationships have already been established and documented in its records.
Application Form Official Formulario MIT (Initial). The form may be signed manually or electronically. A digital certificate (certificado digital) is recommended for electronic procedures but is not necessarily mandatory in every submission method.
Valid Passport A clear copy of the passport's identification page. The passport must be valid when the application is submitted; a full year of remaining validity is not necessarily required.
Proof of Payment of Administrative Fee Modelo 790, Código 038: the standard initial application processing fee is €73.26, rather than the reduced fee applicable to renewals. Verify the current amount before filing.
