Can a US citizen apply for Spain’s Digital Nomad residence permit as a tourist?
Plan an in-country application without confusing lawful stay with permission to work.

Quick summary
- Lawful visitors can apply directly for the residence authorisation.
- The in-country permit can last up to three years, rather than the consular visa’s maximum one year.
- Filing extends the existing stay pending a decision, but is not the same as approval.
You do not need a teleworker visa first
Article 74 quinquies of Law 14/2013 allows foreigners who are regularly in Spain to request the international teleworker residence authorisation. A US citizen with a lawful short stay can therefore use this route. The key is your immigration position when you apply, not simply your nationality or possession of a Spanish address.
This is different from the consular visa under article 74 quater. That visa lasts a maximum of one year, or less if the work period is shorter. The residence authorisation requested inside Spain has a maximum validity of three years, unless a shorter work period is requested. “Three years” is a ceiling, not a promise that every applicant receives that duration.
Check your remaining lawful stay before collecting the last documents
Do not assume that arriving in Spain starts a fresh visitor allowance if you have already spent time elsewhere in the Schengen area. Establish your actual permitted stay using your travel history and immigration documents before choosing a submission date. If your position is unclear, resolve it before relying on the in-country route.
A future appointment, an unfinished online form or a conversation with an adviser is not a filed residence application. Article 76 provides that the application extends the validity of the applicant’s existing residence or stay until the procedure is decided. Plan to submit while that existing status is still valid and keep the electronic registration receipt.
This matters when a decision arrives after your original visitor period would have ended: the legal protection comes from the application, not from an informal intention to apply. It is not a general extension for anyone considering the Digital Nomad route, nor a way to cure an overstay by submitting late.
Being eligible to file is only the first test
The substantive conditions still apply. Under articles 74 bis and 74 ter, the work must qualify as international remote employment or professional activity. The foreign business must have at least one year of real, continuous activity, and the qualifying employment or professional relationship must have existed for at least the preceding three months.
You also need the appropriate qualification or at least three years of relevant professional experience. Financial resources, health coverage, criminal-record requirements and Social Security obligations must be addressed. A US employment contract or high salary does not, by itself, settle all those points. If your work is freelance, our three-client scenario explains why the structure of the relationships matters.
Prepare the application around the actual work arrangement rather than relabelling an employee as a contractor for convenience. The general conditions in article 62 expressly preserve the applicable tax and Social Security obligations.
What should be ready before you submit?
Use the UGE’s published document checklist to assemble the file. It calls for the signed MIT application form, a complete legible passport copy and evidence of payment of fee 790-038. If a representative applies, the file must document their authority to act.
Those administrative items sit alongside the evidence supporting your work, resources and other eligibility conditions. Check document formalities and consistency before submission: names, dates, employer details and the proposed work period should tell the same story. Do not leave the remote-work arrangement or Social Security position to be worked out after your visitor stay runs out.
Applications are processed electronically through the Unidad de Grandes Empresas y Colectivos Estratégicos (UGE), as article 76 specifies. Save the submitted documents and registration receipt, monitor notifications, and respond to any requests within the deadline stated in the notification.
Waiting for approval is not the same as holding the permit
The extension of stay during processing should not be confused with the grant of work rights. Do not treat a submission receipt as the issued teleworker authorisation or assume it replaces the documents needed for travel and re-entry.
After approval, article 76 requires a foreigner identity card (TIE) for an authorisation lasting more than six months. That card stage follows the residence decision; a fingerprint appointment does not replace the initial application.

Common mistakes
- Assuming a US passport guarantees a fresh visitor allowance regardless of earlier Schengen travel.
- Waiting until the stay has expired because an application is being prepared.
- Treating the filing receipt as permission to work or a guaranteed re-entry document.

Frequently asked questions
Must I return to the US to obtain a Digital Nomad Visa first?
Not necessarily. If you are legally in Spain and meet the requirements, article 74 quinquies allows a direct residence-authorisation application.
Will I automatically receive three years?
No. Three years is the statutory maximum for this authorisation; a shorter requested work period can result in a shorter permit.
What if my visitor period ends while the application is pending?
Article 76 extends the existing stay until the procedure is decided when the residence application is filed while that stay is valid. Keep proof of filing and distinguish this from work authorisation and travel rights.
