What arraigo social is
Arraigo social is a temporary residence authorization for exceptional circumstances for foreign nationals who meet the applicable requirements in Spain.
In 2026, it is governed by Real Decreto 1155/2024. It is not the same as arraigo sociolaboral. Arraigo social is based on qualifying family ties and sufficient financial means, or on social integration and sufficient financial means.
General requirements in 2026
You must generally:
- Be in Spain.
- Have remained continuously in Spain for at least 2 years.
- Not be an international protection applicant when filing or during processing.
- Have no criminal record in Spain.
- Provide criminal record certificates from countries of residence during the previous 5 years.
- Not be subject to an entry ban in Spain or in countries with which Spain has an agreement.
- Not be within a non-return commitment period.
- Have paid the fee.
- Not hold another stay or residence authorization.
- Not have another pending application for a stay or residence authorization.
Time as an international protection applicant does not count toward the 2 years until there is a final decision.
Specific requirements
Arraigo social requires qualifying family ties with foreign residents and sufficient financial means. These ties may include a spouse or registered partner and direct relatives in the first degree.
Financial means must reach at least 100% of IPREM.
If those family links do not exist, a favorable social integration report is required. The report assesses residence at the usual address, available financial means and integration efforts.
Documents
The official form is EX-10. The main documents are:
- Completed EX-10.
- Full copy of valid passport, registration certificate or travel document.
- Evidence of continuous presence in Spain for 2 years.
- Criminal record certificate from relevant countries.
- Documents proving family links, where applicable.
- Documents proving sufficient financial means.
- Favorable social integration report, where applicable.
- Proof of payment of Modelo 790, código 052.
Foreign documents may need legalization or apostille and official translation.
Fee, filing and resolution period
The applicable fee is 790 code 052, section 2.3.1. The amount consulted for 2026 is EUR 38.28.
The application is filed before the competent Immigration Office or online through Mercurio:
The general decision period is three months from the day after the application enters the competent register. If no decision is issued within that period, negative administrative silence (silencio administrativo negativo) generally applies.
If documents are incomplete, the Immigration Office may issue a request for correction. Missing that deadline can close the file.
After approval
The initial arraigo social authorization lasts one year and permits employed or self-employed work without geographical or occupational restrictions.
After approval, the foreign person must request the TIE within 1 month. The TIE is handled before the National Police in the province of residence.
Common mistakes
- Submitting foreign criminal-record certificates without an apostille, legalization or sworn translation when required.
- Counting periods that do not qualify because of pending international protection.
