Quick summary

  • The NLV family definition does not include parents.
  • Adding money to your application does not make an excluded relative eligible.
  • An independent NLV application and later family reunification require separate assessments.

Financial dependence does not bring a parent into the NLV family definition

Article 61.3 of Royal Decree 1155/2024 lists a spouse or qualifying partner, minor children and certain adult children with health-related needs. It does not list parents or other ascendants. The regulation took effect on 20 May 2025; use its current consolidated text when assessing a new application.

Your mother’s age, living arrangements and reliance on your support may be important for choosing another route, but they do not add a new category to this definition. The same issue applies to a dependent father or parent-in-law. A birth certificate proves the relationship; it does not establish eligibility under a route that excludes that relationship.

Do not budget for her as an additional dependent

Article 62 sets the NLV financial minimum at 400% of monthly IPREM for the principal applicant, plus 100% for each qualifying dependent. The extra 100% is a financial rule for relatives who fit the route. It is not a way to buy eligibility for a parent.

Hypothetical example: A US retiree plans to move to Spain with her 78-year-old mother and can comfortably support both. She should not prepare a single principal-and-dependent application using 400% plus 100% of IPREM. Her mother’s possible residence basis must be identified separately before the family chooses documents, insurance or travel dates.

Could your mother apply for her own Non-Lucrative Visa?

Potentially. The fact that she cannot accompany you as an NLV dependent does not prevent her from being assessed as a principal applicant. The Ministry’s initial NLV guidance requires sufficient resources, health insurance, the relevant personal documents and a plan to reside without work or professional activity.

For her own application, assess her against the principal applicant’s financial requirement. Gather pension evidence, accessible savings and the records showing who owns and can use those funds. If you intend to fund her application, have the arrangement assessed before transferring money or assuming that a promise of support will be accepted.

Check suitable insurance early, particularly before making non-refundable commitments. Prepare her application for the Spanish consulate responsible for her place of residence. Filing around the same time as yours does not turn two independent applications into a dependent application or guarantee matching decisions.

Later family reunification is not an immediate alternative

The general family-reunification route can include parents, but it is not the same as accompanying an initial NLV applicant. The Ministry’s family-reunification guidance requires the sponsor to hold Spanish long-term or long-term EU residence for reunification of ascendants. Do not assume the ordinary one-year residence rule for other relatives lets you bring your mother at your first NLV renewal.

That route also examines dependency and reasons justifying residence in Spain. Its published conditions generally require a parent to be over 65; humanitarian exceptions can apply below that age. Turning 65 alone does not satisfy the remaining requirements.

Common mistakes

  • Treating financial support or old age as sufficient to include a parent in the NLV family application.
  • Adding only 100% of IPREM without first checking the parent’s eligibility.
  • Assuming that the first NLV renewal automatically allows reunification of a parent.

Frequently asked questions

Does a medical need make my mother an eligible NLV dependent?

Article 61.3’s health-related provision concerns adult children, not parents. A care need warrants assessment of the available routes, but does not by itself place a parent within this NLV definition.

What if I am Spanish or an EU citizen?

Different family-residence rules may apply. This article concerns a parent accompanying a non-EU national on Non-Lucrative Residence, not the family rights of Spanish or EU citizens.
