Quick summary

  • An initial residence authorisation can be requested for six months.
  • The proposed work period and the prior employment history serve different purposes.
  • The duration granted determines whether the law requires a TIE.

Ask for the period your work documents support

Article 74 quinquies(2) of Law 14/2013 sets a three-year maximum and expressly allows for a shorter requested period of work. The migration authority’s Management Criterion 2/2025, signed on 16 July 2025, confirms that it uses the requested period for international teleworker residence, subject to that ceiling. A six-month request is therefore possible even if your employer could otherwise keep you employed for longer.

Write the intended dates into your application and make sure your employment documents support them. The UGE document guide calls for the contract and a letter authorising work from Spain, with the role, main duties, salary in euros and remote-working conditions. If your US employment is indefinite but permission to work from Spain is limited, ask HR to state that distinction and the authorised dates. Check that your financial evidence, healthcare and Social Security arrangements fit the period you are requesting.

Separate your past employment from the six months ahead

For a first application as an employee, article 74 ter generally requires at least three months of employment with the foreign company immediately before filing and at least one year of real, continuous activity by the company or group. The three months are a lookback. Requesting six months in Spain does not reduce that history requirement, and a signed offer for a future six-month assignment does not establish past employment.

Hypothetical example: A US employee has worked for an established US company for two years. HR agrees to six months of remote work from Spain and puts the dates in writing. If the employee is lawfully in Spain and meets the remaining requirements, those facts can support a six-month request. A new hire with the same six-month letter who has yet to start would still need to establish the prior employment required for a first application.

Check the approval dates before booking fingerprints

Under article 76(2), a foreigner identity card (TIE) must be requested when the residence authorisation granted lasts more than six months. Exactly six months does not cross that threshold. Read the dates in the decision rather than relying on the period you asked for, and keep the decision with your passport.

This guide concerns a residence application processed by UGE for an eligible applicant in Spain. The consular visa under article 74 quater has its own maximum of one year, shortened when the work period is shorter. If you are weighing where to file, see our guide for US visitors applying in Spain.

Common mistakes

  • Asking for three years when your employer has authorised only six months of work from Spain.
  • Counting a future assignment toward the required employment history.
  • Booking fingerprints before checking the duration actually granted.

Frequently asked questions

Can I stay longer if my employer extends the assignment?

An extension letter does not extend your residence by itself. Article 74 quinquies(3) allows renewals in two-year periods if the qualifying conditions continue. Check the renewal procedure before your current permit expires.

Does a six-month request make the financial threshold lower per month?

No. The requested period affects how long your resources must cover you. UGE’s monthly minimum still applies, including any additional amount for accompanying family.
