Spain Digital Nomad Visa for Employees: What you need to know
Before the Spanish Startups Law came into force in December 2022, there was no straightforward Spanish residence route specifically designed for non-EU employees who wanted to relocate to Spain while remaining employed and paid by a company based abroad.
The alternatives were often less suitable. The Non-Lucrative Visa did not allow professional activity in Spain, while the self-employed (cuenta propia) route generally required the applicant to establish a self-employed activity rather than remain in a traditional employment relationship. Other routes, such as arraigo, were designed for very different circumstances and required applicants to meet specific residence and other legal requirements.
The introduction of the Spain Digital Nomad Visa (DNV) significantly changed this landscape. The visa was created specifically for international remote workers who carry out their professional activity from Spain for companies or clients located outside Spain, subject to the applicable legal requirements. Basically, it allows the employer-employee relationship to remain essentially the same as it is in London, New York, Dublin or Sydney, with one important difference: the employee is physically based in Spain.
For employees, the Digital Nomad Visa in Spain is one of the most straightforward residence options available for non-EU remote workers. It can provide residence for up to three years when applying from Spain, allow eligible family members to accompany the main applicant, and may provide access to the 24% special tax regime for certain inbound workers, commonly known as the Beckham Law, provided the separate tax requirements are met. Time spent legally residing in Spain under the Digital Nomad Visa may also count towards the relevant residence periods for long-term residence and, where the applicable requirements are fulfilled, eventually Spanish citizenship.
However, there is an important aspect that employees should understand before starting their Digital Nomad Visa application: the application is not assessed solely on the employee's circumstances. The foreign employer and the employment relationship are also a central part of the application. The catch - and there is one - is that the UGE caseworker does not just want to see you, they want to see your employer, too. The documentation submitted with your Spain Digital Nomad Visa application needs to demonstrate that the employment relationship is genuine, ongoing and compliant with the requirements established by the applicable legislation.
In practice, this means that your HR or Legal team may become involved in your relocation to Spain. Your employer may need to provide specific documents, certificates or authorisations confirming your employment relationship and your ability to work remotely from Spain. The quality and consistency of the documentation provided by your employer can therefore have a direct impact on your application.
