Can I Visit the US During My NLV Renewal With an Expired TIE?

Plan a US visit without overlooking the documents needed to return to Spain.

Quick summary

  • A pending renewal and permission to cross the border are separate matters.
  • An autorización de regreso supports return through Spanish border posts, not entry through another Schengen country.
  • Check the document’s actual dates: the 90-day calculation differs before and after residence expiry.

Your renewal receipt does not replace a valid TIE for travel

Filing a Non-Lucrative Residence renewal within the statutory period extends the previous authorisation until the procedure is decided. Article 64 of Royal Decree 1155/2024 provides that protection, but it does not turn the expired plastic card into a current travel document.

For this situation, Article 5 provides the autorización de regreso, a separate return authorisation. You must show that you started the renewal within the legally permitted filing period. A fingerprint appointment or an unfinished application is not evidence that you submitted the residence renewal. Our guide to filing after NLV expiry explains the filing window separately.

Arrange the return authorisation before departure

The National Police procedure page identifies an in-person application and the fee form 790, code 012. Use the official EX-13 application form, selecting the option for a residence authorisation undergoing renewal. The form also asks for your reasons for applying and intended time outside Spain.

Prepare your valid passport, expired TIE and registered renewal receipt to establish your identity and renewal situation, together with EX-13 and proof of fee payment. Check the receiving office’s current appointment and supporting-document instructions. Leave time to obtain the issued document before departure; an appointment booking or a pending EX-13 request is not the return authorisation.

Carry the original issued authorisation and your valid passport for the journey. Keep your expired TIE and renewal evidence available too, and check the airline’s document requirements before travel.

Check when the 90-day period starts

Article 5.2 sets two different calculations. If you request the return authorisation before the residence authorisation expires, its validity is no more than 90 days from that expiry. If you request it after expiry, validity is no more than 90 days from the date the return authorisation is granted.

For the reader whose TIE has already expired, the second calculation is particularly relevant. Do not count 90 days from your flight or assume that every document runs for exactly 90 days. Check the dates actually granted and plan to re-enter before it expires, allowing for possible disruption.

Choose the Spanish border crossing, not just a Spanish final destination

Article 5.6 expressly limits use of the regreso to entry through authorised Spanish border posts. It does not provide a general right to enter through France, Germany or another Schengen country.

Hypothetical example: A US retiree living in Valencia has an expired TIE, a pending NLV renewal and a valid regreso. A New York–Madrid–Valencia itinerary puts the external-border check in Madrid. A New York–Paris–Valencia itinerary normally puts it in Paris instead. The same Spanish final destination does not make the second route equivalent: the regreso alone does not cover entry at the French border.

Arrange your return so that the Schengen external-border entry takes place in Spain. If considering a connection outside Schengen, check that country’s transit requirements separately. Do not assume US visa-free visitor rules replace the documents for returning as a resident with a pending renewal.

Continue monitoring renewal notifications while away. The regreso facilitates travel; it does not approve the renewal or suspend deadlines for responding to the administration.

Common mistakes

  • Leaving with only an expired TIE and a renewal receipt.
  • Booking a Schengen connection without checking where the external-border control takes place.
  • Counting the regreso’s validity from departure instead of checking the dates granted.

Frequently asked questions

Can I make more than one US trip on the same regreso?

Article 5.5 allows multiple entries and exits with one document during its validity. Every return must still be within that validity and through a Spanish authorised border post.

Is a family emergency required for a renewal-related regreso?

Article 5.1 does not make an emergency a general condition for someone renewing within the legal period. Article 5.2 provides priority processing where the trip responds to a situation of necessity; document that need if requesting priority.
