Understand what your spouse needs before accepting a job in Spain.

Quick summary

  • A spouse’s family permit allows local employment and self-employment.
  • The main teleworker’s foreign-employer and 20% rules do not extend to the spouse’s family permit.
  • The spouse still needs valid authorisation and the normal employment registrations.

Why your spouse can work for a Spanish company

Spain’s international teleworker route distinguishes between the person qualifying through remote work and the family member accompanying them. Article 62.4 of Law 14/2013 lets a spouse apply together with the principal applicant or later. The spouse receives their own authorisation; they are not simply added to the principal applicant’s card.

The UGE’s official FAQ, question 17, expressly confirms that family residence authorisations allow both employed and self-employed work without restrictions. A spouse can therefore accept a local job without qualifying independently as an international teleworker. There is no requirement under this family route to have worked for that employer for three months before applying.

The 20% limit belongs to the principal teleworker

Article 74 bis limits the principal employee to work for businesses outside Spain. For a principal applicant working as a self-employed professional, Spanish work cannot exceed 20% of total professional activity.

Those limits do not turn into a household quota. Your spouse’s Spanish salary is not counted as your Spanish professional activity merely because you are married. That follows from the separate authorisations and the UGE’s confirmation of the family member’s work rights.

Hypothetical example: A US software developer qualifies through employment with a US company. Their spouse obtains family residence and accepts an office-based position with a Valencia company. The spouse does not have to make that job remote or limit it to 20% of their working time. The developer must still satisfy the conditions of their own teleworker authorisation.

What to arrange before the first working day

First, check the spouse’s own approval and its effective dates. The principal applicant’s approval, a marriage certificate or proof of submitting the family application is not a substitute for the spouse’s permission to work. If applying through a consulate abroad, complete the applicable visa and entry steps before arranging the start date.

Give the employer the spouse’s identity and residence documents so its payroll team can verify the right to work. If the documentation is unclear, clarify it with the issuing authority before starting.

The spouse also needs a Spanish Social Security number. The government’s employee-registration guidance explains that either the employer or the worker can request a number if one has not been assigned. The employer must then register the employee with Social Security before employment starts. Having a number alone is not the same as being registered for the job.

Does a Spanish job make the spouse’s residence independent?

No. Permission to work under a family authorisation does not automatically convert it into an independent employment-based residence permit. The seventh additional provision of Law 14/2013 requires the conditions supporting the authorisation to be maintained and changes affecting admission conditions to be reported to the UGE within 30 days.

If the principal teleworker loses qualifying work, or the relationship ends, obtain advice about the family permit and any available change of route. Do not assume that the spouse’s Spanish employment preserves the family authorisation by itself.

ANEMOSS ASESORÍA JURÍDICA S.L. can review the family’s eligibility and documents and help coordinate the applications through its Digital Nomad Visa service. If you are not married, see the separate guide to proving an unregistered partnership.

Common mistakes

  • Applying the principal teleworker’s 20% limit to the spouse’s local job.
  • Starting work because the principal applicant has approval while the spouse’s application is still pending.
  • Assuming that a Spanish employment contract automatically makes family residence independent.

Frequently asked questions

Does my spouse need a job offer to apply as a family member?

No. A job offer is not a condition of applying as a spouse under this route. The relationship and the applicable family requirements, including resources and health coverage, must still be documented.

Can my spouse work as an autónomo instead?

Yes. The family authorisation also permits self-employment. The relevant tax, Social Security and any professional registration requirements still apply.
